Civil Union Marriages

The Civil Union Act, 2006 (Act No. 17 of 2006) gives same-sex couples the same rights and status as heterosexual married couples.

  • In terms of the Civil Union Act, anyone 18 years or older may enter into a civil union.
  • The parties to the civil union may choose to have their civil union registered as either a marriage or a civil partnership.
  • Parties to a civil union or a civil partnership may enter into an ante nuptial contract for all the same reasons as any other heterosexual couples would.
